The CUSTOMER violation of the Terms and Conditions described herein will entitle "CARIBEDEPORTES" to cancel or suspend their account immediately, without prior notice and without any liability, for any reason, including but not limited to; it additionally implies incurring in sanctionable conduct ranging from civil to criminal liability.
Minor Registration
“CARIBEDEPORTES” may make certain products or services available to minors as long as they are registered, authorized, and/or supervised by one of their parents or legal guardians (hereinafter referred to as parents or legal guardians as the CUSTOMER) related to the CUSTOMERS. If you order any product or service on the Website, you guarantee that you have the legal capacity to do so and declare that you are the parent or legal guardian with the legal capacity to authorize the minor to use our services and/or participate in our events; therefore, you are obligated to pay the full prices, whether by credit/debit card or other authorized payment methods available in the market, as well as to comply with these terms and conditions. If payment is not received by us from the issuer of your credit or debit card or their agents, the CUSTOMER is obligated to pay all amounts due at the time of our claim. In the event that the CUSTOMER uses a Credit or Debit Card of which they are not the holder, they are obligated to obtain the corresponding authorization from the holder of that card for its use; otherwise, they release “CARIBEDEPORTES,” its affiliates, subsidiaries, or business partners from any responsibility in this regard for the charge that may be made for the requested services.
Notwithstanding the above, by registering a minor to use our services either on the Website or to participate in a sports EVENT organized or operated by "CARIBEDEPORTES," you declare that you are the Parent, Guardian, or Legal Guardian, who will be responsible for the use of such services by the minor, including any injury, damage, harm, or medical attention that they may suffer or require as a result of their participation in any sports EVENT.
Some products and/or services that the CUSTOMER requests, downloads, or uses on or through the Website may be subject to additional terms and conditions that will be presented to them at the time of such purchase or download.
“CARIBEDEPORTES” does not make direct sales to minors, so it is recommended that parents and guardians carry out the activities of purchasing services or registering on the Website themselves.
Inscription
“CARIBEDEPORTES” provides the service of capturing inscriptions for the sports events organized or operated by it. The CUSTOMER accepts and acknowledges that in the event that they request or acquire a inscription by any means other than those indicated on the Website, including through any individual not associated with our Website, it will be the CUSTOMER's responsibility to make the payment, and if applicable, that such inscription may be canceled.
In the event that "CARIBEDEPORTES" detects that fraud has been committed against it or against the organizers to whom "CARIBEDEPORTES" provides the inscription services, it reserves the right to cancel such inscription, and even to take legal action as necessary to ensure that the CUSTOMER pays the amounts owed and accrued related to the sporting events in which they intend to participate.
Derecho de Inscripción
“CARIBEDEPORTES” reserves the right to enrol the CUSTOMER and/or Participant when it deems necessary, without any responsibility in this regard. The reservation of the right to enrol is based, without limitation, on violations of this agreement of wills, such as: the CUSTOMER and/or Participant providing incorrect information on the inscription forms, making or being detected in the misuse of credit or debit cards, or abusing the system to the detriment of “CARIBEDEPORTES”.
“CARIBEDEPORTES” reserves the right to enrol both the CUSTOMER and/or Participant, as well as the holder of the credit and/or debit card with which the CUSTOMER and/or Participant inscripted.
Likewise, THE CUSTOMER and/or participant and/or the holder of the credit and/or debit card authorizes “CARIBEDEPORTES” to charge the respective amount to the card provided, accepting all its terms and conditions regarding said charge, waiving any right or claim against “CARIBEDEPORTES” or the financial institution issuing the card used, including the request for a chargeback for an event that arises concerning the aforementioned charge and releasing “CARIBEDEPORTES” from all responsibility in this regard, committing to settle the amount that they have agreed to cover with their Card, and without raising any type of claim to deny the charge made, understanding that such action may be considered a crime to the detriment of “CARIBEDEPORTES” or the organizers of sporting events requesting the registration capture service, acknowledging and accepting that THE CUSTOMER and/or Participant that “CARIBEDEPORTES” reserves the rights or legal actions as applicable.
Release of liability for participation in in-person and/or virtual events (the “EVENT”)
The PARTICIPANT declares that the following statements are correct:
THE PARTICIPANT agrees to sign the waiver requested by "CARIBEDEPORTES" to participate in any EVENT organized or operated by the latter, whether in-person or virtual, and expressly states that they are aware of the nature of the EVENT they wish to participate in, as well as their physical abilities and experience, stating that these are suitable for participation. Due to the above, they expressly declare that they are in perfect health, both physically and mentally, to participate in the EVENT and to carry out each and every activity that takes place within it.
It also states that it is aware of the development and activities of the EVENT, and in the event that the Organizing Committee considers any of these to be unsafe or pose a risk to THE PARTICIPANT or others present, it may cancel the event without any liability to the Organizing Committee. Therefore, if the instructions issued by the Organizing Committee are not taken into consideration, it expressly assumes the consequences that may arise from its failure to pay attention, action, or negligence regarding the instructions of the Organizing Committee, releasing the Organizing Committee and/or "CARIBEDEPORTES" from any type of liability, including when it comes to the execution of a virtual EVENT.
THE PARTICIPANT expressly acknowledges and agrees that:
- The activities that take place during the EVENT are at your own risk, and participation in it; as well as your entry to any area of the in-person EVENT or any place or route you choose to take for the virtual EVENT in question, may or could cause you physical or mental harm, including partial or total disability, paralysis, or even death (collectively referred to as the RISKS); these RISKS may be caused by your own omission, activity, or inactivity before, during, or after the EVENT, or by the negligence of the individuals whom you hereby release from any type of liability, or by the weather conditions at the location where the EVENT is held.
Liability in case of accident.
In the event of an accident or injury occurring during the EVENT, the PARTICIPANT agrees and consents to receive the necessary first aid medical attention, in accordance with the provisions established in the liability waiver (exemption) that must be signed before participating in the EVENT.
Notwithstanding the above and in the event that the PARTICIPANT needs to be transferred to a medical care center, they acknowledge and accept that all expenses must be covered directly by the PARTICIPANT or their relatives.
Modification of Terms and Conditions
“CARIBEDEPORTES” reserves the right to modify these Terms and Conditions at any time. Changes will be notified to the CLIENTS by posting them on the website.

The CUSTOMER acknowledges and agrees that "CARIBEDEPORTES" is an independent organization from third-party sponsors and advertisers whose information, images, advertisements, and other advertising or promotional material (hereinafter referred to as "advertising material") may be published on the Website.
The CUSTOMER acknowledges and agrees that the advertising material is not part of the main content published on said Website. “CARIBEDEPORTES” does not control or take responsibility for third-party websites or their content, information, software, products, or materials included therein, which may be accessed through the website, via banners or links made available to the CUSTOMER. Furthermore, the CUSTOMER acknowledges and agrees at this moment that such material is protected by applicable intellectual and industrial property laws, and therefore “CARIBEDEPORTES” disclaims all responsibility regarding the information contained in the advertisements or materials provided by third-party business partners.
Data protection
By registering on the Website, Platform, APP, and social media, the CUSTOMER accepts and acknowledges that “CARIBEDEPORTES” will have access to certain sensitive personal information (including but not limited to, facial photographs, fingerprints, photographs or scans of official identification, home address, official identification number, voice, etc.), including Biometrics, for the purpose of allowing the Client to have faster or express access to the services offered on the Website, as well as access to the benefits provided to Participants of the events organized or operated by “CARIBEDEPORTES.” The CUSTOMER, at the time of registering on the Website, Platform, APP, and social media, expresses their authorization to be part of the “CARIBEDEPORTES” database; therefore, if they do not wish to be part of it, they must express their desire through a request, in accordance with the Personal Information Protection and Electronic Documents Act, as stated in the Privacy Notice of the Website.
In compliance with the requirements established by PIPEDA (Personal Information Protection and Electronic Documents Act), the personal data of the CLIENTS will be processed in accordance with our Privacy Policy. The CLIENT has the right to access, rectify, and delete their data, among other rights.
Intellectual property
TAll the content of the website, the set of trademarks, whether figurative or not, as well as all illustrations, brands, images, logos, and any content present on the website (including, by way of example and not limitation), in accordance with the General Terms of Use, are and will remain the exclusive property of "CARIBEDEPORTES" or the holder of the corresponding intellectual property rights.
It is expressly prohibited for the CUSTOMER or PARTICIPANT to reproduce, modify, alter, or delete, total or partial use of such trademarks, illustrations, images, and logos or any other content of the website, for any reason and in any medium, without the prior and express written consent of “CARIBEDEPORTES” or the holder of the corresponding intellectual property rights. The above provision shall also apply to copyrights, designs, and models, as well as patents present on the website.
In this act, the CLIENT acknowledges and accepts that in the event of a Virtual EVENT and if they share any type of photograph, image, or information regarding their participation or that of their minor children in the EVENT on the Website, such information, photographs, or images may be used in any way by "CARIBEDEPORTES," as upon publication, they become public information, and therefore the CLIENT does not reserve any rights or actions against "CARIBEDEPORTES" for the use of the same.
In the event that the CUSTOMER transmits to “CARIBEDEPORTES” any personal and sensitive information through the registration carried out on our Website or in the services provided therein, the CUSTOMER hereby grants “CARIBEDEPORTES” a free, non-exclusive and royalty-free license; so that said information forms part of the database of “CARIBEDEPORTES”, and may be used for commercial, advertising, information or any other purposes related to the services offered by “CARIBEDEPORTES” its affiliates, subsidiaries, sponsors, organizers, business partners and any third party related to the corporate purpose of “CARIBEDEPORTES.COM”; therefore, in the event that the CUSTOMER wishes to be excluded from said database, he/she must send a request, in terms of the Law on the Protection of Personal Information and Electronic Documents), to the site https://www.caribedeportes.com.
For the above reasons, the Client expressly waives in this act any action, lawsuit, or claim against “CARIBEDEPORTES.COM”, its affiliates, subsidiaries, partners, or suppliers for any current or potential violation of any copyright or intellectual property rights arising from the information and other material that the user themselves submits to the Website.
It is our policy to act against violations of intellectual property that may arise or originate as stipulated in the legislation and other applicable intellectual property laws, including the removal or blocking of access to material that is subject to activities that infringe on the intellectual property rights of third parties.
Limitation of Liability

The information available on the website is provided without any warranty, either implied or express, regarding its completeness, accuracy, timeliness, non-infringement, availability, reliability, or integrity of the data, sporting events, or services appearing on the website, or regarding their suitability for the use that the user intends to make of them. “CARIBEDEPORTES” disclaims all responsibility for direct and indirect damages, foreseeable or not, suffered as a result of the use of the website. If liability is established for damages suffered by the CUSTOMER, attributable solely to the execution of the order, such liability will be limited to the amount of the order that the CUSTOMER has paid.
To the maximum extent permitted by applicable law, in no event shall “CARIBEDEPORTES” or its suppliers be liable for any special, incidental, indirect, or consequential damages of any kind (including, but not limited to, damages for loss of profits, loss of data or other information, due to business interruption, personal injury, loss of privacy arising from or in any way related to the use or inability to use the service, third-party software and/or third-party hardware used with the service, or otherwise in connection with any provision of these Terms), even if “CARIBEDEPORTES” or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Fraud control

The CLIENT and/or Participant is warned that they may be exposed to legal proceedings in the event of claims initiated due to chargebacks for fraud.
In the context of the fight against Internet fraud, data related to the CUSTOMER may be communicated to third parties authorized by law or designated by "CARIBEDEPORTES" solely for the purpose of verifying the identity of the CUSTOMER and/or Participant, as well as the validity of the application and the payment method used.
Applicable law and jurisdiction
The Terms and Conditions expressed here will be subject to the laws currently in force in Canada. Any dispute, agreement, or mediation will be resolved within the Canadian jurisdiction system.
Penalties
“CARIBEDEPORTES” and its subsidiaries or directors, to the best of his knowledge, are not controlled by any person and/or entity that is currently subject to sanctions administered by the United States of America, the Office of Foreign Assets Control (“OFAC”) of the Department of the Treasury, the United Nations Security Council, the European Union, or any other relevant and duly recognized sanctioning authority.
